These Terms of Service ("Terms") govern the relationship between DUYAPP YAZILIM LİMİTED ŞİRKETİ ("DuyApp") and the person who uses the DuyApp mobile application (the "App") (the "User"). The Community Guidelines form an integral part of these Terms.

These Terms apply to the use of the App and all features offered through the App. The processing of personal data is described in the Privacy Policy and the KVKK Disclosure Notice. Acceptance of the Terms does not mean that explicit consent has been given for the processing of personal data for every purpose or for its transfer abroad. A separate choice is offered for operations that require explicit consent.

DuyApp is not affiliated with any university, school, municipality or public authority. The university and campus names that appear in the App are used only to indicate the region of the content.

2. Formation of the agreement

These Terms are formed when the User declares, at registration, that they have read and accepted the Terms by ticking a separate checkbox. The current text of the Terms is always accessible from the Settings section of the App and at duyapp.com/en/terms, and may be saved. DuyApp records which version the User accepted and on which date.

For an App downloaded from the App Store, Apple's Standard End User License Agreement applies to the extent that DuyApp has not provided a separate custom end user licence agreement in App Store Connect. Apple is not a party to these Terms.

3. Who may use the App

Each natural person may open only one account. Accounts are personal and may not be transferred to another person, sold or shared. An account may not be opened on behalf of another person or organisation, or with false information.

DuyApp verifies access to the university email address. This verification does not, on its own, show that the person is at least 18 years old or that they are a registered student of the relevant university. The User is obliged to comply with the age limit and not to make misleading statements about their age. Accounts of users found to be under 18 years of age are closed.

4. Account and security

Sign-in to the account is carried out with a passkey created on the User's device. The User is responsible for the security of the device that holds the passkey and of the registered email address. A User who suspects that the account is being used without authorisation must notify destek@duyapp.com without delay.

The User may delete their account at any time from within the App. Which data is deleted when the account is deleted, and for how long other data is retained, is described in the Privacy Policy and on the Delete Account page. Deletion of an account cannot be undone.

The User uses the App in accordance with applicable legislation, these Terms and the Community Guidelines. DuyApp shows no tolerance whatsoever toward the unacceptable content defined in the Community Guidelines and toward abusive users.

In response to content and conduct that violate these Terms or the Community Guidelines, DuyApp may apply one or more of the following sanctions, depending on the seriousness of the violation:

Sanction decisions are made by the moderation team and are notified to the User together with their grounds. In urgent situations such as a threat to life, the abuse of children, a serious threat of violence, a decision of a competent authority or an attack on system security, a sanction may be applied without prior notification.

DuyApp may monitor content through automated filters and human review and may apply the measures above. These operations do not constitute a commitment that every piece of content will be reviewed before publication, that all violations will be detected, or that they will be removed immediately. The fact that content remains published is not an approval or an assurance. Reports and appeals are handled under Article 7.

Cooperation with competent authorities

The User retains their rights over the posts, comments, photographs and other content they share in the App; the rights of third parties are reserved. The User is responsible for holding the rights and permissions necessary for sharing, for the lawfulness of the content, and for not infringing the rights of others. User content does not reflect DuyApp's opinion, approval or any commitment to its accuracy.

Under Law No. 5846 on Intellectual and Artistic Works, the User grants DuyApp a non-exclusive and royalty-free licence of use (simple licence) for the content they share, under the following terms:

The User's moral rights in the content are reserved. The User exercises the right to publish their content under a pseudonym or anonymously. This licence of use does not, on its own, constitute a legal basis for the processing of personal data or a safeguard for transfer abroad; the conditions set out in the KVKK Disclosure Notice apply separately to those operations.

10. Artificial intelligence features

Duyu is a chat and summary feature that makes use of third-party artificial intelligence services. Duyu Fun is a feature consisting of fictional posts, comments and images produced by artificial intelligence.

All rights in the software and design of the App and in the names and logos of DuyApp and Duyu belong to DuyApp. DuyApp grants the User a non-exclusive, non-transferable and revocable right to use the App for personal purposes in accordance with these Terms.

Suggestions and feedback that the User submits to DuyApp may be used to improve the App without any payment to the User.

13. Third-party services

The App makes use of third parties that provide artificial intelligence, GIF and image content, map and location, hosting and notification services. Source links in Duyu's answers lead to third-party websites. The content and services of these sites are the responsibility of their own providers; providing a link does not mean that DuyApp endorses the relevant content or service or guarantees its accuracy, security or continuity. The App Store's and Google Play's own terms apply to the download and updating of the App.

14. Limitation of liability

User content and relationships between users

The User is themselves responsible for the posts, comments, photographs, messages and other content they create, upload, send or share, for the rights and permissions required for them, for their unlawful conduct, and for the relationships they establish with other persons. Anonymous sharing does not change this responsibility. DuyApp provides the technical environment for the sharing of user content; it does not adopt this content as its own statement and is not a party to relationships, transactions or disputes between users. DuyApp does not guarantee the accuracy, reliability or lawfulness of this content, or that it does not infringe the rights of others. DuyApp disclaims liability for losses arising from user content, from the conduct of other users, or from transactions made in reliance on this content.

Duyu and Duyu Fun outputs

The User is responsible for the prompts and content they submit to Duyu, for their decision to use or share the outputs, and for the consequences of that use. Duyu and Duyu Fun outputs may contain statements that are inaccurate, incomplete, fabricated, disturbing or unsuitable for the intended use. These outputs are not verified information, expert opinion, a verified statement about real persons or events, or a commitment of DuyApp. DuyApp does not guarantee that the outputs are accurate, complete, current, original, fit for a particular purpose or free from third-party rights. Before using or publishing the outputs or acting on them, the User is obliged to assess independently their accuracy and the appropriateness of their use. DuyApp disclaims liability for losses arising from decisions taken in reliance on the outputs, transactions made, content published, or the use of these by third parties.

Moderation

DuyApp's filtering, review, ranking or moderation of content does not mean that the accuracy, lawfulness or reliability of the relevant content has been approved. The presence of content on the platform, its having passed review or its not having been removed cannot be interpreted as having been adopted by DuyApp or as any assurance having been given. These mechanisms do not guarantee that all violations will be prevented, detected or remedied immediately; they do not transfer to DuyApp the User's responsibility for their own content and conduct.

Use of the service and losses

The App and the artificial intelligence features are provided as they are available and accessible. No guarantee is given of uninterrupted or error-free operation, or of compatibility with every device and purpose of use. DuyApp is not liable for losses arising from interruptions in third-party services, from events beyond its reasonable control, or from the User's negligence in the security of their account or device. No liability is accepted for claims relating to indirect losses, loss of profit or revenue, loss of business and opportunity, or loss of reputation. In cases of slight negligence where liability cannot be excluded entirely, liability is limited to the direct losses that were reasonably foreseeable at the time the agreement was formed.

Claims arising from the User's breach

The User is obliged to compensate losses attributable to their own fault arising from sharing unlawful content, infringing the intellectual property, personality or personal data rights of third parties, or using the App in breach of these Terms. This obligation covers the actual losses suffered by DuyApp and by its managers, representatives and employees acting within the scope of providing the service, the compensation they are obliged to pay, and reasonable, documented attorney and defence costs. Losses attributed to the fault of DuyApp or of the relevant person cannot be imposed on the User.

A third-party claim is notified to the User; the User assists the defence to a reasonable extent by providing the relevant information and documents in their possession. The User's right to object to the claim and the costs is reserved. A settlement made by DuyApp without the User's consent does not, on its own, create a payment obligation for the User.

Protected persons and scope of application

The limitations of liability in this section also apply in favour of DuyApp's managers, representatives and employees acting within the scope of providing the service. The limitations apply irrespective of whether the claim is based on contract, tort or any other legal ground.

The limitations of liability in this section apply to the fullest extent permitted by law; intent, gross negligence and other liabilities that cannot be limited by law, as well as non-waivable consumer rights, are reserved.

15. Changes to the service and to the Terms

DuyApp may change the features of the App and these Terms because of changes in legislation, decisions of competent authorities, security requirements, technical necessities or the addition of new features.

16. Termination of the agreement

The User may terminate the agreement at any time by deleting their account.

DuyApp may suspend or close the account if one of the following legitimate grounds exists:

After the closure of the account, Articles 5, 9 (limited to statutory retention periods), 14 and 17 remain in force.

17. Governing law and disputes

The law of the Republic of Turkey applies to these Terms. Users who have consumer status may apply to consumer arbitration committees within the monetary limits determined each year by the Ministry of Trade, and, for disputes exceeding these limits, to consumer courts following the mandatory mediation process. The User has the right to apply to the consumer arbitration committee and consumer court at their own place of residence.

DuyApp's electronic records may be used as evidence under Law No. 6100 on Civil Procedure. The User's right to submit counter-evidence is reserved.
